Adult Liability Waiver Policy

I agree that I must follow all instructions given by the Sky Dinner Poin Panama City staff throughout the entire experience, including before it begins.
I am mentally prepared, free from altitude sickness, alcohol intoxication, or any other similar condition that would prevent me from participating in the experience. If, before the start of the experience, I suffer from any of the aforementioned conditions or experience cramps, asthma attacks, circulatory problems, or any other condition that would render me unable to participate, I will immediately notify the Sky Dinner Poin Panama City staff.
I will inform the Sky Dinner Poin Panama City staff in advance of any medical condition that may affect my participation in the experience. Likewise, I will take all necessary precautions to avoid any inconvenience during the experience.
I will maintain responsible behavior that does not increase the risks to my physical or mental integrity, and if during the experience I suffer any type of injury or any other circumstance that may affect my health or that of other participants, I will immediately contact the Sky Dinner Poin Panama City staff.
If I exhibit inappropriate, undesirable, or reckless behavior before or during the experience, or if I need to use the restroom and/or descend to the ground during the ascent or after having ascended, the Sky Dinner Poin Panama City staff will lower the platform and/or leave me on the ground without re-ascending and without a refund.
I am responsible for my belongings and will not be able to claim lost or abandoned items before, during, or after the experience.

Minor Liability Waiver Policy

I am the responsible adult/guardian of the minor.

The mentioned minor will participate in the Sky Dinner Poin Panama City experience alongside me, and in this regard, I take full responsibility for their care and behavior during the event. I declare that the minor will comply with all the rules of the experience, as signed by the undersigned in this document.

I commit to ensuring that the minor does not consume any alcoholic beverages or controlled substances.

The undersigned assumes full responsibility for the aforementioned minor and releases and exempts Sky Dinner Poin Panama City, its operating company, partners, directors, and/or any person associated with them from any claims for personal liability, third-party liability, third-party damages, or any other type of claim arising from the minor’s participation in the event in cases of disobedience, negligence, recklessness, or lack of my supervision.

The customer who purchases a ticket for Sky Dinner acknowledges that the minimum number of reservations required for the activity to take place is eight (8) people. Therefore, they accept that 360 Real Estate Business S.A. may reschedule the activity until the required minimum is met. Customer service personnel will call and coordinate availability until the activity is confirmed. This activity will only have a waiting period of 10 minutes for delays. After this time, the reservation will be considered canceled without a refund due to force majeure or unforeseen circumstances.

By reserving, purchasing, and/or acquiring tickets for any of the activities promoted on this page, 360 Real Estate Business S.A. will not refund the amount paid by the customer to the company after the purchase process and confirmation of the activity under the stated conditions.

LEGAL LIABILITY WAIVER AND ASSUMPTION OF RISK DECLARATION FOR THE PRACTICE OF SPORTS AND/OR RECREATIONAL ACTIVITIES AT POIN.

THE CLIENT:

I declare that I understand and accept that all activities conducted by 360 REAL ESTATE BUSINESS, S.A., registered under electronic folio No. 155720397 in the Mercantile section of the Public Registry of Panama, at its premises located in Calidonia, Unit No. 1 in PH THE SANDS AVENIDA BALBOA, operating under the trade name POIN (hereinafter referred to as POIN), involve sports and/or recreational activities that carry inherent risks. I acknowledge that participation in such activities requires good physical and mental health, and therefore, I declare that I do not suffer from any condition that could compromise my physical condition or the safety of others involved in these activities.

USAGE RULES

  1. The client declares that they have received the mandatory safety briefing from POIN staff.

  2.  

    The client agrees to adhere to the usage rules of the equipment.

  3.  

    The client commits to immediately reporting any alarm signs, incidents, mishaps, setbacks, damages, accidents, injuries, losses, or thefts they may suffer.

  4.  

    The client is obligated to fully comply with all rules outlined in the safety protocol.

  5.  

    The client understands that the fee does not cover any repairs or damages resulting from negligent use.

  6.  

    The client acknowledges that if they carry any type of device and it is dropped, damaged, or lost, POIN is exempt from liability.

  7.  

    The client authorizes POIN to charge their credit/debit card for rental fees, equipment damages, and any other costs or liabilities outlined in these conditions.

CLIENT DECLARATIONS

  1. The client acknowledges and accepts that activities at POIN carry high risks and assumes full responsibility for associated risks, including their own actions or omissions.

  2.  

    The client assumes risks related to falls, injuries, cuts, general illnesses, infections, and any present or future consequences affecting their health and physical integrity occurring at POIN facilities.

  3.  

    If the participant is a minor, the undersigned assumes full responsibility for the risks associated with the minor’s participation.

  4.  

    The client acknowledges that POIN does not provide insurance or coverage for clients, providers, visitors, or service users.

  5.  

    The client accepts that POIN is not responsible for any loss, theft, or damage to their property at POIN facilities or during activities.

  6.  

    POIN is not liable for any loss, theft, or damages to stored items.

  7.  

    The client is responsible for any damages caused to third parties, their property, or POIN equipment due to their own fault, negligence, or intentional misconduct.

  8.  

    The client understands that participation is not permitted while under the influence of alcohol or drugs, and no refunds will be issued.

  9.  

    POIN, its shareholders, executives, subscribers, and employees shall not be liable for direct, indirect, punitive, or incidental damages, including but not limited to property damage, personal injury, or death arising from the use of its equipment and facilities.

  10.  

    POIN, its shareholders, executives, and employees shall not be liable for claims, actions, or demands arising from any loss, accident, damage, injury, disability, or death due to client negligence or improper use of POIN equipment and facilities.

  11.  

    The client waives any civil, criminal, administrative, or commercial indemnity claims and legal action against POIN, its legal representatives, agents, subsidiaries, or any associated persons regarding the services and activities provided at POIN.

PERSONAL DATA

The client authorizes the automated processing of personal data collected in this contract for service provision, as well as for offering and contracting additional POIN services. The client consents to POIN sharing their data with affiliated companies or partners to enhance equipment rental services.

Additionally, the client declares they have been informed of their rights under Panama’s Personal Data Protection Law 81, regulated by Executive Decree 285 of May 28, 2021. They authorize and grant rights for the publication of their information, data, videos, images, and other audiovisual content in mass media and social networks for the purpose of image promotion. By signing this document, the client acknowledges, understands, accepts, and agrees to comply with the guidelines for participating in activities.

DECLARATION

The client declares that they fully waive legal liability and assume all risks associated with participating in sports and/or recreational activities at POIN. They understand that by signing, they freely subscribe without incentive or coercion, intending that this waiver be complete and unconditional to the fullest extent permitted by law. If any part of this agreement is deemed invalid, the remaining provisions shall retain full legal force and effect.

The client acknowledges that the minimum number of reservations required for Sky Dinner to proceed is eight (8) people. Therefore, they accept that 360 Real Estate Business S.A. may reschedule the activity until the required minimum is met. Customer service will contact the client to coordinate availability and confirm the activity.

This activity allows a maximum waiting time of 10 minutes for delays. After this period, the reservation will be considered canceled without refund due to force majeure or unforeseen circumstances.

By reserving, purchasing, or acquiring tickets for any activities promoted on this page, 360 Real Estate Business S.A. will not refund any amount paid by the client after purchase and activity confirmation under the stated conditions.
