ACCEPTANCE OF TERMS

This document constitutes a legal agreement between the CLIENT (user, consumer, or purchaser) and the company (hereinafter, “THE COMPANY”), owner and operator of the “Sky Selfie” experience.

By acquiring the service, whether directly, in a promotional package, or through authorized third parties, THE CLIENT declares having read, understood, and fully accepted these Terms and Conditions, as well as the complementary policies referenced herein.

SERVICE DESCRIPTION

Sky Selfie is a sensory and visual entertainment experience that offers participants the opportunity to access a fixed platform for a 20-minute period, including:

– One (1) drink (glass of wine or soda).
– One (1) professional digital photograph included in the package.

The cost of the service is thirty U.S. dollars (US$30.00) per person, plus VAT (ITBMS).

WEATHER CONDITIONS

The execution of the service is subject to favorable weather conditions. For operational safety reasons, THE COMPANY may cancel, suspend, or reschedule the activity if there are adverse meteorological conditions such as rain, strong winds, thunderstorms, or any other force majeure or unforeseen event that may affect the physical integrity of participants or the equipment.

OPERATIONAL AVAILABILITY

The “Sky Selfie” service shares technical platform space with other experiences offered by THE COMPANY, such as “Sky Dinner,” so its availability will depend on prior scheduling of events or other confirmed reservations. THE COMPANY reserves the right to suspend or reschedule the Sky Selfie experience for operational, logistical, or maintenance reasons, without this implying any obligation for compensation beyond what is established in the cancellation policy.

PARTICIPATION CONDITIONS

To participate, THE CLIENT must:

– Be over 18 years of age or be accompanied by a responsible adult with written authorization from a legal guardian.
– Not have medical conditions that contraindicate activities at heights.
– Not be under the influence of alcohol, narcotics, or medications that compromise stability.

THE COMPANY reserves the right of admission for safety reasons and may deny access without refund if these conditions are not met.

CANCELLATION AND REFUND POLICY

Cancellation due to weather conditions
If the experience is canceled before the ascent and the package content (drink/photo) has not been delivered, THE CLIENT may choose to:
– Reschedule the activity at no cost within the next 30 calendar days (subject to availability).
– Request a full refund of the amount paid.

Suspension for operational reasons (platform use in another event)
In the event of cancellation due to a priority reservation (Sky Dinner or others), the following will be offered:
– Rescheduling at no cost for another date.
– Full refund if the client does not wish to reschedule.

Cancellation by the client
Voluntary cancellation requests must be submitted at least 48 hours in advance. THE COMPANY may offer rescheduling or credit, subject to case evaluation.
No refunds will be granted for no-shows or late cancellations.

Purchases under package or promotions
If Sky Selfie was purchased as part of a “FULL PASS” package, the activity may be rescheduled at no cost, according to the package rules and availability.

COMPLEMENTARY POLICIES

Purchasing the service implies express acceptance of THE COMPANY’s general policies on:
-Cancell ationsand refunds.
– Safety and admission.
– Image use and reproduction rights (the included professional photograph may be used by THE COMPANY for promotional purposes unless the client submits a written objection).

These policies are available for review through THE COMPANY’s official channels.

MODIFICATIONS

THE COMPANY reserves the right to update these Terms and Conditions at any time, notifying clients through its official channels (website, email, or social media). The conditions in force at the time of purchase will continue to apply to the respective contract.

APPLICABLE LAW AND DISPUTE RESOLUTION

These terms shall be governed and interpreted in accordance with the laws of the Republic of Panama, particularly the provisions of Law No. 45 of 2007 on consumer protection and competition defense, and Law No. 2 of 2006 on public shows, as well as other administrative, tax, or municipal regulations governing tourism, entertainment, or consumption activities. In case of a dispute, the parties may turn to the Consumer Protection and Competition Defense Authority (ACODECO) or the ordinary Panamanian jurisdiction.

FINAL PROVISIONS

Any situation not provided for in this document will be evaluated by THE COMPANY’s administrative team.
Acquiring the service implies acceptance of all content in this document.
